Recently I was forced to relieve a volunteer basketball coach from his coaching duties within the non-profit youth athletic program of which I founded. The coach continued to exhibit negligence with money, even after being addressed on several occasions. If you know anything about non-profit youth programs, money is not easy to come by, so negligence dealing with money is intolerable.
His last incident really boiled my collar. He offered to assist another coach in ordering team uniforms. Now, this seems like a generous and innocent gesture, except for the fact he totally overlooked the memo that was distributed stating that all uniforms would be ordered by our program director and neglected to inform the director or myself. Unbeknownst to me or the director he held a meeting with parents and collected money six hundred and fifty dollars for the uniforms. Parents waited patiently for six months for him to either return the money or the uniforms, he did neither. Finally they contacted our program director, who contacted me and I contacted him. He said he would return the money when he had it. ?What?!?, I replied, ?That money should be available. It should be in the bank account we established for you?. He responded by telling me, the founder of the organization, to stay out of it. My thoughts were simply, ?Are you serious??. I stopped communication immediately and delivered a letter to him stating he would no longer be allowed to volunteer for the organization and must return the money within thirty days or legal action would be pursued.
I ventured down to the District Court and requested information to file a small claims lawsuit. They gave me the required paperwork and suggested I contact an attorney. As mentioned earlier, non-profit youth organizations are... well... broke, so I requested information regarding lecial aid. I called the number that was given to me and they referred me to a contingency lawyer. When I called the lawyer I got a voice message and after stating the law firm name, hours etc., it also state, ?We get paid after you get paid?. I thought, ?Cool, that?s even better?. The next day I received a call from a paralegal who took my intake information. I asked for some information regarding the law firm so she emailed me a pamphlet. The pamphlet listed, workers compensation, social security disability benefits, construction site accidents, car accidents, and personal injury lawsuits as cases they have been successful in winning. After reading the brochure I felt comfortable with the firm and decided to move forward with the lawsuit.
The lawyer assigned to my case handled everything, from completing the required documents, to ensuring the defendant was served, to representing me in court. The whole process went smooth. The settlement included attorney fees, court fees and even a little interest. I didn?t come out of pocket with a dime and the organization received more money than expected. We also looked professional.
Working with a contingency lawyer was a great move. The lawyer I worked with was great, the process was smooth and I felt confident the whole way. If you have a good case, definitely look at getting a contingency lawyer.
